Web Design and Mobile App Development
We support payment plans based on defined installments for all our custom design projects to provide clients with the utmost convenience. However, payments or deposits, once made, are non-refundable. If a project is canceled or delayed, Avancera Solution retains all payments. Additionally, the client must pay for any work completed beyond what has already been covered.
Monthly Maintenance Plan
When outlined in the project scope, Clients must provide all text (digitally) and images/photos for new content. Unused hours do not carry over to the next month, and no refunds are given for unused hours. Fees related to website maintenance services are non-refundable. A $100 administrative fee applies to late payments or declined credit card charges. Clients can cancel or renew services anytime via their account dashboard or email. Avancera Solution may terminate all client agreements at any time with written notice.
Digital Marketing Plans
Clients must understand, agree, and acknowledge that Avancera Solution has no control over search engine or directory policies regarding site and content acceptance in the current state or in the future. Search engines or directories may exclude a client's site at their own discretion without prior intimation or communication. Although not specified, it may take two (2) to four (4) months or longer for listings or updates to appear on search engines and directories. Avancera Solution is not liable for any changes made by third parties that negatively impact the client's website's search engine or directory rankings.
Indemnification
Clients agree to indemnify and hold harmless Avancera Solution and its affiliates, co-brands, officers, and or other partners against any claims, damages, liabilities, costs, and expenses arising from the content provided by the client or any infringement claims related to that content.
As mentioned, claims, damages, liabilities, costs, and expenses including, but not limited to, reasonable attorneys’ fees and all related costs and expenses incurred by Avancera Solution as a result of any judgment, adjudication, or claim against Avancera Solution related to or arising from (a) any photographs, illustrations, graphics, audio clips, video clips, text, data or any other information, content, display, or material (whether written, graphic, sound, or otherwise) provided by client to Avancera Solution (the “Client Content”), or (b) a claim that Avancera Solution’s use of the Client Content infringes the intellectual property rights of a third party. To qualify for such defense and payment, Avancera solution must (i) give Client prompt written notice of a claim and (ii) allow Client to control and fully cooperate with Client in the defense and all related negotiations.
Disclaimer
Avancera Solution does not guarantee that its digital marketing services will meet client expectations. The entire risk as to the quality and performance is with the client. Services are provided "as is" without any warranties except those explicitly stated in the agreement. Both parties disclaim all other warranties, including implied warranties of merchantability and fitness for a particular purpose. If any provision of this agreement shall be unlawful, void, or for any reason is unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
Limited Liability
This agreement outlines some limitations on Avancera Solution's responsibility. Avancera Solution cannot be held liable for certain types of damages, even if there are issues with the service. This includes things like lost profits, even if they were expected or Avancera Solution was aware they might happen. Additionally, we aren't responsible for damages related to implied warranties or those based on past business practices. Data loss and problems with services, content, or equipment from other companies are also outside of Avancera Solution's scope of responsibility. Avancera Solution provides no refunds. Avancera Solution makes no warranty of any kind, whether express or implied, with regard to any third-party services, third-party content, or any software, equipment, or hardware obtained from third parties.
Confidentiality
Both parties agree to keep each other's confidential and proprietary information strictly confidential, including but is not limited to, written or oral contracts, trade secrets, business methods, reports, and or financial information.
Force Majeure
This agreement acknowledges that unexpected events can happen, and neither you nor Avancera Solution will be held responsible for delays or issues caused by circumstances beyond your control. These unforeseen situations could be anything from natural disasters to power outages or even new government regulations. As long as both parties perform commercially reasonable diligence and make a reasonable effort to overcome these challenges, there's no penalty for delays or disruptions. However, if a force majeure event occurs, the affected party should promptly notify the other party in writing and take steps to minimize the impact as much as possible.
By signing up for our services, you are confirming that you have read and understood this agreement and agree to abide by its terms and conditions.
Print Design
Design costs paid to Avancera Solution are non-refundable. Refunds for printing costs are only given if a printing error is determined to be our fault. Avancera Solution, its co-brands, partners, officers, or affiliates, are not liable for damages incurred due to printing errors or problems from our files if full specifications from your printer were not provided or were incorrect and or inaccurate, or if you supply the wrong files to your printer.
Chargebacks
When Avancera Solution receives a chargeback request or payment dispute either through PayPal Dispute, from a credit card company or bank, or from online outsourcing platforms, the client’s service and/or project will be suspended without notice. A $100 chargeback fee (issued to recover fees passed on to us by the credit company), plus any outstanding balances accrued due to the chargeback(s) must be paid in full before services are restored, files delivered, or any further work is done. Rather than issuing a chargeback, clients are requested to contact us to address any billing issues. Requesting a chargeback, opening a PayPal dispute, or opening any outsourcing platform dispute for a valid charge from us is a fraud and is never an appropriate or legal means of obtaining a refund. Please read and make sure you fully understand our refund policy before making project or service payments.
Moneyback Guarantee
The moneyback guarantee is void if the client requests revisions after reviewing the initial samples. Once feedback is provided and changes are requested, the project moves to the revision phase, and the guarantee no longer applies. However, Avancera Solution is committed to delivering the best services to all clients and accommodating reasonable revision requests to ensure client satisfaction.
